1. Regulatory Authorization

OMC Investments LLC is authorized and regulated by the Dubai Financial Services Authority (DFSA) under registration number XXXXX. We operate in accordance with DFSA Rules and the laws of the Dubai International Financial Centre (DIFC).

2. Anti-Money Laundering (AML) and Counter-Terrorist Financing (CTF)

OMC Investments maintains a comprehensive AML/CTF program in compliance with:

  • UAE Federal Law No. 20 of 2018 on Anti-Money Laundering and Combating the Financing of Terrorism
  • UAE Federal Law No. 1 of 2004 on Combating Terrorist Offences
  • DFSA Anti-Money Laundering, Counter-Terrorist Financing and Sanctions Module (AML)
  • Financial Action Task Force (FATF) Recommendations

Our AML/CTF Measures Include:

  • Customer Due Diligence (CDD) and Enhanced Due Diligence (EDD) procedures

3. Know Your Customer (KYC) Requirements

All investors must complete our KYC process before investing. Required documentation includes:

For Individual Investors:

  • Valid passport or Emirates ID
  • Proof of address (utility bill or bank statement, less than 3 months old)
  • Source of funds declaration
  • Tax residency information (FATCA/CRS forms)
  • Employment and income information

For Corporate/Entity Investors:

  • Certificate of incorporation and commercial license
  • Memorandum and Articles of Association
  • Shareholder register and ownership structure (beneficial owners)
  • Board resolution authorizing investment
  • KYC documents for all beneficial owners (25%+ ownership)
  • Financial statements (latest audited)

4. Investor Classification

Under DFSA rules, we classify investors as:

  • Professional Clients: Sophisticated investors meeting DFSA criteria for assets, experience, or professional qualifications
  • Retail Clients: Individual investors not meeting Professional Client criteria, entitled to enhanced regulatory protections

Your investor classification affects the level of regulatory protection and the types of products available to you.

5. Suitability and Appropriateness

Before accepting your investment, we assess:

  • Your investment objectives and financial situation
  • Your knowledge and experience in investments
  • Your risk tolerance and capacity for loss
  • Your investment time horizon

We will not accept investments that we deem unsuitable or inappropriate for your circumstances.

6. Data Protection and Privacy

We comply with the DIFC Data Protection Law No. 5 of 2020 and UAE Federal Law No. 45 of 2021 on the Protection of Personal Data. We implement appropriate technical and organizational measures to protect your personal information.

7. FATCA and CRS Compliance

OMC Investments complies with:

  • FATCA: Foreign Account Tax Compliance Act - reporting requirements for US persons
  • CRS: Common Reporting Standard - automatic exchange of financial account information

We collect tax residency information from all investors and report to relevant authorities as required by law.

8. Shariah Compliance

For Shariah-compliant products, we maintain a Shariah Supervisory Board comprising qualified Islamic scholars who:

  • Review and approve investment structures
  • Ensure ongoing compliance with Shariah principles
  • Conduct regular audits of investments and operations
  • Issue annual Shariah compliance certificates

9. Conflicts of Interest

We maintain a Conflicts of Interest Policy to identify, manage, and disclose potential conflicts. We prioritize client interests and disclose any material conflicts that may arise.

10. Complaints Handling

We maintain a formal complaints handling procedure in accordance with DFSA requirements. If you have a complaint:

  1. Submit your complaint in writing to complaints@omc-investments.ae
  2. We will acknowledge receipt within 2 business days
  3. We will investigate and respond within 30 business days
  4. If unsatisfied, you may escalate to the DFSA

11. Financial Crime Prevention

We implement robust systems to prevent:

  • Money laundering and terrorist financing
  • Fraud and market manipulation
  • Bribery and corruption
  • Sanctions violations
  • Insider trading and market abuse

12. Record Keeping

We maintain comprehensive records of all transactions, communications, and documents for a minimum of 6 years in compliance with regulatory requirements.

13. Audit and Oversight

OMC Investments undergoes:

  • Annual external audits by DFSA-approved auditors
